Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

  • Cooling-Off Period: The time frame in which the consumer may exercise the right to cancel the contract.

  • Consumer: A natural person not acting on behalf of a business, entering into a distance contract with the seller.

  • Day: Calendar day.

  • Ongoing Transaction: A contract for regular delivery of goods or services over a period of time.

  • Durable Medium: A format that allows the consumer or seller to store information for future reference (e.g., email, PDF).

  • Right of Withdrawal: The consumer’s right to cancel the contract within the Cooling-Off Period.

  • Seller/Entrepreneur: Refers to Arrilavo, the company offering goods or services via distance selling.

  • Distance Contract: An agreement concluded remotely using electronic communication (e.g., via website or email).

  • Means of Distance Communication: Tools used to conclude a contract without both parties physically present.

  • General Terms and Conditions: These terms that govern the use of Arrilavo’s services.

Article 3 – Scope

These Terms apply to all offers, sales, and distance contracts made by Arrilavo to U.S. consumers.

A copy of these Terms will be provided prior to concluding any purchase. If not immediately possible, they will be made available electronically or upon request, free of charge.

Where product-specific terms differ, the more favorable terms for the consumer shall apply.

If any provision is declared unenforceable, the remaining provisions remain valid. Ambiguities are to be interpreted in line with the intent and fairness of these terms.

Article 4 – Offers

Offers are non-binding and subject to change. Key offer components:

  • Clear product/service descriptions

  • Accurate images (colors may differ slightly)

  • Total price, excluding applicable state sales tax, import duties, or brokerage fees

  • Delivery, payment, and return terms

  • Whether the Right of Withdrawal applies

  • Duration of the offer and pricing guarantees

For international orders (e.g., UK), import duties or VAT may be charged by the courier.

Article 5 – Contract Formation

A contract is concluded once the consumer accepts the offer and meets the specified requirements.

For online purchases:

  • Confirmation of acceptance is sent via email.

  • Arrilavo uses secure technology to protect consumer data and payment details.

  • Arrilavo may assess credit risk before confirming large transactions.

Upon order confirmation, Arrilavo will provide:

  • Company contact info

  • Return/refund policy

  • Warranty details

  • Payment and cancellation rights

Article 6 – Right of Withdrawal

Consumers may cancel their purchase within 14 calendar days of receiving the item.

To exercise this right:

  • Notify Arrilavo by email within 14 days of receipt.

  • Return the item in original condition within the next 14 days.

  • Retain return shipment proof.

If these conditions are not met, the return may be denied.

Article 7 – Return Costs

Consumers are responsible for return shipping costs.

Refunds will be issued within 14 days of product receipt or proof of return.

Article 8 – Exceptions to Right of Withdrawal

Withdrawal rights do not apply to:

  • Custom or personalized goods

  • Perishable items

  • Unsealed hygiene products

  • Unsealed media (e.g., software, DVDs)

  • Services already performed with consumer’s consent

  • Non-refundable tickets or time-bound leisure bookings

Article 9 – Pricing

Prices are valid during the offer period unless:

  • Changes are required by law (e.g., sales tax)

  • Prices are influenced by currency or market fluctuations (notified in advance)

U.S. customers may be responsible for sales tax, and international buyers may face duties or VAT charged on delivery.

Article 10 – Conformity and Warranty

Products must conform to the contract and function as expected.

Warranties:

  • Reflect those of the manufacturer

  • Do not affect your statutory U.S. consumer rights

Exclusions:

  • Improper use or repairs

  • Failure to follow usage instructions

  • Damage caused after delivery

Article 11 – Shipping & Delivery

  • Orders are typically shipped within 14 calendar days

  • Delays will be communicated promptly

  • Consumers may cancel orders if delivery is unreasonably delayed

  • Risk of loss transfers upon delivery

If a product is unavailable, Arrilavo may offer an alternative. If accepted and returned, Arrilavo bears the return shipping cost.

Article 12 – Subscriptions & Renewals

Termination:

  • Consumers may cancel auto-renewing subscriptions with 30 days’ notice

  • No forced renewal beyond initial term without consent

Renewals:

  • Subscriptions cannot renew indefinitely without notice

  • Free trials will not auto-renew into paid subscriptions without explicit consent

Long-term contracts may be canceled after one year with 30 days’ notice

Article 13 – Payments

Unless otherwise stated, payments must be made within 7 business days of placing the order.

Consumers must notify Arrilavo of billing issues promptly.

Late payments may incur service charges, which will be communicated in advance.

Article 14 – Complaints

Complaints must be submitted in writing within 30 days of the issue.

Arrilavo responds to all complaints within 14 days. If resolution takes longer, the consumer will be informed.

If unresolved, disputes will follow the process in Article 15.

Complaints do not suspend the customer’s payment obligation.

Article 15 – Dispute Resolution & Governing Law

All contracts and disputes are governed by U.S. law, specifically the laws of the State of [Insert State, e.g., California].

Disputes that cannot be resolved amicably may be brought to small claims court or resolved through binding arbitration as required by local law.
